Welcome to read the "APP User Service Agreement" (hereinafter referred to as "this Agreement"). This Agreement sets forth the terms and conditions applicable to your (hereinafter referred to as "User") use of various products and services of the APP.
1.1 PROFORMANCE DIAGNOSTICS LLC and its related affiliated enterprises (hereinafter collectively referred to as "PROFORMANCE DIAGNOSTICS LLC") agree to provide services related to ProFromance APP, etc. (hereinafter referred to as "ProFromance") in accordance with the provisions of this Agreement and its operational rules published from time to time.
1.2 Users of ProFromance (hereinafter referred to as "Users") should fully understand the entire content of this Agreement, independently consider, acknowledge, agree to all the terms of this Agreement, and complete all registration procedures as prompted on the page. The user's registration, login, and usage actions will be deemed as a complete acceptance of this Agreement and the various rules and norms published by PROFORMANCE DIAGNOSTICS LLC.
1.3 PROFORMANCE DIAGNOSTICS LLC has the right to supervise, prompt, inspect, and correct all activities on CardFix Genius-II APP and the official website of Zhengde Youbang.
2.1 The specific content of ProFromance is provided by PROFORMANCE DIAGNOSTICS LLC based on actual conditions, including but not limited to authorizing users to upload, search, and push relevant information to interrelated users through their accounts, authorizing users to include, share, etc. PROFORMANCE DIAGNOSTICS LLC has the right to upgrade or make other adjustments to the services or product forms it provides, and will notify users of such changes through updates to the APP/website content, without separately notifying users.
2.2 ProFromance provided by PROFORMANCE DIAGNOSTICS LLC may include advertisements, and users agree to display advertisements from Huansheng Intelligent and third-party suppliers, partners during use.
2.3 PROFORMANCE DIAGNOSTICS LLC only provides technical services related to ProFromance, and users are responsible for their own devices (such as personal computers, phones, and other devices related to internet or mobile networks) and associated costs (such as telephone and internet fees for internet access, mobile phone fees for using mobile networks).
3.1 Due to the special nature of internet services (including but not limited to force majeure, network stability, system stability, technical failures, user location, user shutdown, user phone viruses, or malicious network attacks, and any other technical, internet, communication line, content infringement, etc.), users agree that PROFORMANCE DIAGNOSTICS LLC has the right to interrupt or terminate part or all of ProFromance at any time. PROFORMANCE DIAGNOSTICS LLC will notify users as promptly as possible in a reasonable manner and repair it as soon as possible. However, PROFORMANCE DIAGNOSTICS LLC is not responsible for any consequences that may prevent users from sending and receiving messages or cause errors in sending and receiving messages due to this, and users should bear such risks.
3.2 Users understand that PROFORMANCE DIAGNOSTICS LLC needs to regularly or irregularly inspect and maintain the platform or related devices that provide ProFromance. If the service is interrupted for a reasonable period due to such circumstances, PROFORMANCE DIAGNOSTICS LLC will notify as far in advance as possible, but is not liable for any consequences.
3.3 If the user's personal information is not true, or the user violates laws, regulations, national policies, or the usage rules specified in this agreement, Huansheng Intelligent Company has the right to interrupt or terminate the provision of ProFromance under this agreement to the user at any time without any liability to the user or any third party.
4.1 When applying for registration with ProFromance, the user must provide accurate personal information to PROFORMANCE DIAGNOSTICS LLC (including name, gender, date of birth, phone number, email, etc. for individuals; name, registered address, registration number, etc. for entities). If there is any change in the personal information, the user must update it promptly. The user is responsible for any losses suffered by both parties or any third party due to the authenticity of the information provided by the user.
4.2 After the user successfully registers, they will obtain a Huansheng Intelligent account, and the user is responsible for safeguarding that account. The user shall be liable for any legal responsibilities related to actions taken on that account.
During the use of ProFromance, users must adhere to the following principles:
(1) Comply with relevant laws and regulations in China;
(2) Do not use ProFromance for any illegal purposes;
(3) Adhere to all network protocols, regulations, and procedures related to internet services;
(4) Do not engage in any behavior that may adversely affect the normal operation of the internet using CardFix Genius-II;
(5) Do not engage in any behavior detrimental to Zhengde Youbang Company using its network service system.
4.3 Users are not allowed to use ProFromance to create, upload, send, or spread sensitive information and information that violates the national legal system, including but not limited to the following:
(1) Opposing the basic principles established by the constitution;
(2) Endangering national security, leaking state secrets, subverting state power, and undermining national unity;
(3) Harming the honor and interests of the country;
(4) Inciting ethnic hatred, discrimination, and undermining ethnic unity;
(5) Undermining the country's religious policies, promoting cults, and feudal superstitions;
(6) Spreading rumors, disrupting social order, and undermining social stability;
(7) Disseminating obscene, pornographic, gambling, violent, murderous, terroristic, or incitement to criminal behavior;
(8) Insulting or defaming others, infringing on the legitimate rights and interests of others;
(9) Containing other content prohibited by laws and regulations.
4.4 Users agree not to use the accounts of other users under any circumstances. If you suspect that others are using your account, you agree to notify Huansheng Intelligent Company immediately.
4.5 Users have the right to change or delete personal information, registration information, and transmitted content in ProFromance, but changing the information may also delete any text and images stored in the system. Users need to bear this risk.
